Terms of Use

The Terms of Use is the Service agreement that you must adhere to in order to use our services. This agreement is binding and is subject to change. Service Obligations: Smarteletec S.L., undertakes to provide the Customers with eSIM Numbers in more than 52 countries and is planning to add more countries in the future. Provide the Customers with the ability to call (Send/Receive) to any landline and mobiles all over the world according to the rates provided on Numero app. Provide the Customers with the ability to communicate SMS (Send/Receive-if enabled) to all mobiles all over the world according to the rates provided on Numero app. Rates for calling or sending SMS for specific destinations are subjected to change without prior notice, Rates can always be checked prior to placing a call or sending SMS. Save as expressly set out herein, all conditions or warranties which may be implied or incorporated into this contract by law or otherwise are hereby expressly excluded to the extent permitted by law. In no circumstances, whatsoever will Smarteletec S.L. be liable for economic, indirect or consequential loss. The liability of Smarteletec S.L. (if any) in contract, tort, negligence or otherwise arising out of or in connection with the supply of Service hereunder shall be limited in respect of any one event or a series of two or more connected events to the account’s one month’s spend, averaged over the proceeding 12 months, to a maximum of 100 Euro. Save where the Service is terminated by Smarteletec S.L. without cause, the Customer shall not be entitled to a refund of subscriptions paid. Smarteletec S.L. is providing the calls and the SMS based on sending the Customers ability to Call or Send SMS to any phone number worldwide, with the Customer Caller ID “Your eSIM Number” appears on the receiving party; However, the receiving third party telecom operators can decide to override the received Caller ID (eSIM Number) for Calls or SMS; if this took place; then we are not liable or responsible for these third-party decisions. All your Personal Information or data are kept private and safeguarded, more about this can be found in Privacy Policy. As other Customers or public users might add your eSIM number to be able to communicate with you so your eSIM number is not classified as Private or Personal Information.

Acceptable Use of Service

  1.  Customer agrees to use the Services, Software and Websites only for purposes permitted by this Agreement as well as any applicable law, regulation or generally accepted practices or guidelines in the relevant jurisdictions.
  2. Customer shall not use the Service or authorize the Service to be used directly or indirectly, to transmit Inappropriate Content. Inappropriate Content includes but is not limited to unsolicited material, spam, obscene and sexually explicit material and content that violates Applicable Law, or constitutes hate directed at an individual or a group based on race, sex, national origin, religious affiliation, sexual orientation or language of such individual or group.
  3. Customer shall not use the Service to perform unusual calling patterns inconsistent with normal, individual use, where normal use is for example, regular calls of short duration or calls to multiple numbers in a short period of time; or sending junk or bulk messages, or any other high volume multiperson calling or messaging purposes.
  4. Customer shall not use the Service to engage in unusually high usage of the Services from individual accounts or employ any automated programs such as bots or clones (non-person-to-person communications) that may impair our ability to provide the service to other customers and/or indicate misuse of the service.
  5. The Customer is prohibited from using the Service for callback calls, auto-dialing, continuous or extensive call forwarding, telemarketing (including, without limitation, charitable or political solicitation or polling, unsolicited or unauthorized advertising or spam), fax or voicemail broadcasting or fax or voicemail blasting purposes.
  6. Customer agrees to indemnify Smarteletec S.L. against any cost and/or damage and/or expense and/or claim and/or demand, including any made by a third party, arising out of the Customer’s or End User’s use of the service in violation of the Acceptable Use of Services, and all costs relating thereto, all of which will immediately be due and payable.
  7. Any attempt to do any of the foregoing is a violation of our rights. If You breach this restriction, you may be subject to prosecution and damages and we may, at our sole discretion, terminate your license and bar you from accessing the Services.
